Terms of Service

Please read the following agreement fully and carefully before using this website or any of its sub-pages.

This page constitutes a legal agreement and is the Terms of Service for use of the MyTreated.com website and all of its sub-pages (hereinafter referred to as “Treat.ED”). By using Treat.ED, you agree to fully comply with and be bound by the following agreement.

1. Definitions
Treat.ED is an interactive on-line service consisting of information services and content provided by Treat.ED, affiliates of Treat.ED, and other third-parties. The term Client refers to each person or entity who accesses the Treat.ED website or  submits a profile listing to the Professional Directory at Treat.ED (hereinafter referred to as the “directory”).

2. General
(A) Treat.ED provides general information. Treat.ED is not intended to serve as a substitute for professional advice, diagnosis, treatment, medical treatment, psychotherapy, counseling, or any other mental health or professional service. Client shall not substitute Treat.ED for professional advice, diagnosis, treatment, medical treatment, psychotherapy, counseling, or any other mental health or professional service. Client shall always seek the advice of a health care professional with any question regarding any symptoms or conditions. Client shall never disregard professional psychological or medical advice, or delay in seeking professional psychological or medical advice, because of any content or information provided by or on Treat.ED.

(B) Treat.ED does not recommend, endorse, or promote any specific tests, products, procedures, opinions, services, or other information mentioned or referenced on Treat.ED, or on or by outside websites, services, or agencies mentioned or referenced on Treat.ED. Reliance on any information provided by or on Treat.ED, others noted or referenced by or on Treat.ED, or other visitors to Treat.ED is solely at Client’s own risk.

(C) Treat.ED maintains a directory as a service for Clients interested in working with mental health care and other professionals (including, but not limited to, therapists, counselors, marriage and family therapists, social workers, psychologists, psychiatrists, nurse practitioners, dieticians, nutritionists, physicians, group practices, treatment centers, etc.). Treat ED does not recommend or endorse any of the mental health care and/or other professionals listed in the directory.

(D) Treat.ED does not provide any warranties pertaining to the information contained in or resulting from any of the mental health care and/or other professionals listed in the directory. Information accessed through the directory is provided as is and without any warranty, either expressed or implied, including, but not limited to, any implied warranty of merchantability or fitness.

(E) Treat.ED does not examine, determine, or warrant the competence of any mental health care and/or other professional listed in the directory. Treat.ED does not warrant that the mental health care and/or other professionals listed in the directory are currently, actively, or properly licensed. The directory should not be used to verify the credentials of mental health care and/or other professionals. Client shall contact the relevant State Professional Licensing Board to verify the licensure of any professional. Use of the directory to locate, contact, or receive services from a mental health care and/or other professional is wholly voluntary and will not result in any liability against Treat.ED. In no event shall Treat.ED be liable for damages to any user or Client of Treat.ED.

(F) Any Treat.ED Client who submits content, questions, or comments to Treat.ED acknowledges that such content, questions, or comments may be published on the Treat.ED website. By submitting content, questions, or comments to Treat.ED, Client gives Treat.ED permission to publish the submitted content, questions, or comments. Client understands that it is Client’s responsibility to exclude identifying information from content, questions, or comments submitted to Treat.ED. Further, any Client who submits content, questions, or comments to Treat.ED understands and acknowledges that Treat.ED reserves the right, in its sole discretion, to not publish submitted content, questions, or comments.

(G) Treat.ED shall have the right, at any time, to change or discontinue any aspect, feature, or service, including, but not limited to, content, hours of availability, equipment needed for access or use, or any other aspect of Treat.ED.

(H) Any Client who registers for membership in the directory, and who is approved to advertise in the directory, acknowledges the existence of the Terms of Service applicable to all Clients. Client agrees, by virtue of registering for membership in the directory, to all of the terms, provisions, and conditions contained in these Terms of Service. Please see below for the additional Terms of Service for directory members. These additional acknowledgments and agreements do not apply to any Client who is not a member of the directory.

3. Client Conduct
(A) Client shall use Treat.ED for lawful purposes only. Client shall not post or transmit through Treat.ED any material or communication which violates or infringes, in any way, upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, or which encourages, or may have the tendency to encourage, conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law. Any conduct by a Client that, in the sole discretion of Treat.ED, restricts or inhibits any other Client from using or enjoying Treat.ED will not be permitted.

(B) Client shall not upload, post, or otherwise make available on Treat.ED any material protected by copyright, trademark, or any other proprietary right without the express permission of the owner of the copyright, trademark, or other proprietary right. The burden of determining that any material is not protected by copyright rests with the Client. Client shall be solely liable for any damage resulting from any infringement of copyright, proprietary right, or any other harm resulting from such a submission.

4.Third-Party Content
(A) Treat.ED is a licenser or distributor (not a publisher) of content supplied by third-parties and clients. As such, there are cases in which Treat.ED has no editorial control over such content. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third-parties, including information providers, Clients, or any other user of Treat.ED, are those of the respective author(s) or distributor(s), not of Treat.ED.

(B) Neither Treat.ED, nor any third-party provider of information, guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose.

(C) Third-party content available through Treat.ED represents the opinions or judgments of the respective information provider, Client, or other user. Treat.ED neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made on Treat.ED by anyone other than authorized Treat.ED representatives while acting in their official capacity.

(D) Under no circumstances will Treat.ED be liable for any loss or damage caused by Client’s reliance on information obtained through Treat.ED. It is Client’s responsibility to evaluate the accuracy, completeness, or usefulness of any information, opinion, advice, or other content available through Treat.ED. Client is responsible for seeking the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice, or other content.

(E) Treat.ED does not endorse, and is not responsible for, the content on any third-party websites, sites framed within Treat.ED, or third-party advertisements. Treat.ED does not make any representations regarding the content or accuracy of any third-party websites, sites framed within Treat.ED, or third-party advertisements.

(F) Client’s use of third-party websites is at Client’s own risk and is subject to the terms and conditions of use for such sites.

5. Terms Applicable to Professionals Listed in the Directory
(A) Client agrees to provide true, accurate, current, and complete information about themselves and their mental health and/or other professional practice as prompted by Treat.ED’s sign up procedures and to maintain and update this information to keep it true, accurate, current, and complete.

(B) Treat.ED shall have the right to terminate Client’s account in the event of any conduct by Client which Treat.ED, in its sole discretion, considers to be unacceptable, or in the event of any breach by Client of this Agreement. This Agreement shall survive termination of Client’s account.

(C) Although Client may request that his or her profile be removed from the directory prior to the lapse of his or her membership term, Treat.ED shall not issue refunds in either this or other circumstances.

(D) Client agrees that all personal information entered by Client and stored by Treat.ED may be transferred and shared in the event that Treat.ED should be sold or given to another organization, corporation, or individual.

(E) Client agrees to indemnify, defend, and hold harmless Treat.ED against any loss or liability resulting from the posting of the information provided by you, the Client, including, but not limited to, any claims by third parties who may use your service.

(F) Client’s membership to the directory is personal to Client and is not transferable.

6. Disclaimer of Warranty and Limitation of Liability
(A) Client expressly agrees that use of Treat.ED is at client’s sole risk. Neither Treat.ED, its affiliates, nor any of their respective officers, directors, employees, agents, third-party content providers, or licensers warrant that Treat.ED will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from the use of Treat.ED.

(B) Treat.ED is provided on an as is basis. To the fullest extent permitted by law, Treat.ED disclaims all warranties, express or implied, including, but not limited to, any implied warranty of fitness for a particular purpose, any implied warranty of non-infringement, and any implied warranty of merchantability. Treat.ED makes no warranty about the accuracy, reliability, completeness, or timeliness of the Treat.ED website. Treat.ED makes no warranty that services provided by Treat.ED will be uninterrupted, that the functions shall be error-free, or that the Treat.ED website or the servers that make it available are free of viruses or other harmful components.

(C) This disclaimer of liability applies to any damages or injury caused by any failure of performance, negligence, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, equipment failure, or any other act of God.

(D) Client specifically acknowledges that Treat.ED is not liable for any defamatory, offensive, or illegal conduct of other Clients or third-parties. Client specifically acknowledges that the risk of injury from the foregoing rests entirely with Client.

(E) In no event will Treat.ED, or any person or entity involved in creating, maintaining, producing, or distributing Treat.ED products or materials, be liable for any damages, including, but not limited to, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use Treat.ED. Client specifically acknowledges that the provisions of this section apply to all content on the Treat.ED website.

(F) Neither Treat.ED, nor its affiliates, information providers, or content partners, shall be liable, regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or inauthenticity of, the information provided by Treat.ED, or for any delay or interruption in the transmission thereof to Client, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits or punitive or consequential damages. Neither Treat.ED, nor its affiliates, information providers, or content partners, warrant or guarantee the timeliness, sequence, accuracy, or completeness of this information. There are no warranties regarding the results obtained, or which may be obtained, from the use of Treat.ED.

7. Indemnification
Client agrees to defend, indemnify, and hold harmless Treat.ED, its affiliates, and their respective directors, officers, employees, and agents from and against all claims and expenses, including, but not limited to, attorney fees, arising out of the use of Treat.ED by Client or Client’s account.

8. Right to Monitor
Treat.ED shall have the right, but not the obligation, to monitor the content of the Treat.ED website to determine compliance with this Agreement and to satisfy any law, regulation, or authorized government request. Treat.ED shall have the right, in its sole discretion, to edit, refuse to post, or remove any material submitted to or posted on Treat.ED. Treat.ED shall have the right to remove any material from Treat.ED that Treat.ED, in its sole discretion, deems objectionable or in violation of the provisions of this Agreement.

9. Privacy of Minors
Treat.ED does not intend or design to attract minors under the age of 18 to Treat.ED. Treat.ED does not collect information from any person we actually know is under the age of 18.

10. Severability
Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions of this Agreement shall remain in full force and effect.

11. Applicable Law
This Agreement is governed by the laws of the District of Columbia, without regard to its conflict of law principles. Client agrees that the District of Columbia shall be the forum for any legal action relating to the Treat.ED website, its contents, or services.

12. Amendment
Treat.ED may amend this Agreement at any time. Treat.ED will post notification(s) of changes on the Treat.ED website and will e-mail notification(s) of changes to registered Clients. Client’s continued use of Treat.ED after the posting on the Treat.ED website of any changes (whether or not Client has received or read notification(s) of changes by e-mail) indicates Client’s acceptance of such changes.

13. Miscellaneous
(A) The failure of Treat.ED to enforce any provision or right as found in this agreement will not constitute a waiver of such provision or right.

(B) To the extent that any content is in conflict with or inconsistent with this agreement, this agreement shall take precedence.

(C) The use of section headings in this agreement is merely for convenience and in no way limits or defines how this agreement should be construed.

14. Entire Agreement
This agreement, and any operating rules for Treat.ED, constitute the entire agreement of the parties and sets forth all terms and conditions that apply to Client’s use of Treat.ED. This agreement supersedes all previous written or oral agreements between the parties with respect to such subject matter. By using or continuing to use Treat.ED, Client agrees to comply with all of the terms and conditions incorporated herein.
